Under Georgia's drunk-driving laws, the Department of Driver Services has the authority to suspend your driver's license if you (a) tested over the legal BAC limit or (b) refused to submit to the breathalyzer or blood test. You have only 10 business days after your arrest to submit an appeal, or you will automatically lose your license after 30 days.

Like the administrative license suspension, the penalties for a DUI conviction depend on your prior drunk-driving offenses. Georgia has a mandatory minimum sentence for each offense, which means that—while the judge can increase the penalty—he or she cannot sentence you below the minimum. So even if this is your first DUI, you could be sentenced to at least 24 hours behind bars. On the other hand, you could be sentenced to at least one year in prison for a fourth offense.
