Bankruptcy and Divorce
We get questions every day regarding how bankruptcy and divorce work together. In fact separation and divorce are a very common cause of debt problems that lead to bankruptcy. Some common questions include:
Will my husband or wife be affected if I file bankruptcy?
-A spouse will usually only be affected if there is joint debt.
Should I file bankruptcy before or after I get divorced?
- It depends, but a filing bankruptcy together will usually result in less fees since only one case would be filed.
Can I get divorced while I'm in a bankruptcy case?
It is possible to get divorced while in bankruptcy, but if you do it the court will need to approve the divorce settlement. Also, you will no longer be able to remain in the joint case.
