In the UK, retrospective laws are strictly frowned upon, but are permitted by virtue of the doctrine of Parliamentary Sovereignty. In 1998, however, the Human Rights Act gave the courts the power to declare that an Act unjustifiably infringed human rights. Lord Lester of Herne Hill QC and Monica Carss-Frisk were of the opinion that the FSMA 2000 was bad law and in breach of the Human Rights Act. Anthony Speaight QC took this view also. Gordon Brown claimed that he had legal opinion to say the FSMA 2000 was compatible. Well when challenged he refused to release this! Was this because Gordon did not have this legal opinion? Well done Godfrey Bloom you are a right thinking man.
