ESCANABA - The Upper Peninsula Sportsman's Alliance (UPSA) has joined in a lawsuit to delist the gray wolf. Minnesota resident Dale Luek filed a suit in federal court requesting the government delist wolves in Minnesota, Wisconsin and the Upper Peninsula. His suit was filed on behalf of himself, livestock producers, hunters, trappers and pet owners in the Midwest.According to Rory Mattson, executive director of the Delta Conservation District, UPSA filed a friend of the court motion to delist the gray wolf in Michigan from federal authority.
The motion to delist the species is based upon a 1992 revision of the federal wolf recovery plan and a 1997 state wolf recovery and management plan.
"The motion was filed on behalf of the sportsmen and women in the U.P. who use and recreate in the outdoors," said Mattson.
Mattson said 20 different groups signed the Michigan agreement, including Kerry Mullin of the Michigan Humane Society; Cynthia Radcliffe of the National Wildlife Federation; Marvin Roberson of the Sierra Club, Steven Schaub of the Timber Wolf Alliance; John Vucetich of The Wildlife Society; and Nancy Warren representing the Defenders of Wildlife.
Prior to this attempt to delist the species, the U.S. Fish and Wildlife Service had also made attempts to delist the gray wolf. The organization's action prompted the Humane Society of the United States (HSUS) to file a suit blocking the delisting attempt. As a result of the motion being granted, the Fish and Wildlife Service decided not to move forward.
Mattson said it could have been another five years before any attempt at delisting was made.
The motion by UPSA seeks to have jurisdiction of management for the gray wolf placed under the authority of the Michigan Department of Natural Resources and Environment (DNRE).
"However, our motion is entirely dependent upon the USPA being able to raise the necessary funds for such a venture," said Mattson.
Luek's suit was filed April 22. During this time the Minnesota and Wisconsin DNR's petitioned the Fish and Wildlife Service to delist the gray wolf.
"This action by both Minnesota and Wisconsin in support of the suit filed against the federal government is a positive step in showing the Fish and Wildlife Service is in violation of the Endangered Species Act. However, glaringly absent at this point is action by the Michigan DNRE," said Mattson.
In 1992, a recognized population of gray wolves in Wisconsin and the Upper Peninsula were classified as endangered, while the population in Minnesota was classified as threatened.
At this time the population of wolves in Wisconsin and the U.P. was established as ranging between 45 and 60 animals.
In 1981, a criteria for the growth, sustainability and eventual delisting of wolves stated the Minnesota population needed to be stable or growing, with its continued survival being assured.
"A second population outside of Minnesota and Isle Royale must be re-established, having at least 100 wolves in late winter if located within 100 miles of the Minnesota wolf population, or at least 200 wolves if located beyond that distance," said Mattson, referring to the state and federal plan for allowing the wolf population to regenerate to sustainable levels.
Under the plan presented in 1981, the population numbers needed only be maintained for a period of five years before any attempt at delisting would occur, he added.
As the population of the gray wolf rebounded under the 1981 plan to promote healthy growth, a new wolf management plan was implemented in Michigan in 1997.
Another wolf management plan, adopted in 2008, reflected the need for maintenance of a viable wolf population above a level which would warrant continued classification as either threatened or endangered.
"The 2008 wolf management plan also calls for the facilitation of wolf-related benefits, and minimizing wolf-related conflicts. It also calls for science-based wolf management with socially accepted methods being used," said Mattson.
According to Mattson, the gray wolf population in Michigan has continued to grow and thrive with numbers now exceeding the federal level for classification as threatened or endangered.
In 1989, there were three wolves in the Upper Peninsula, with the population having grown at an annual rate of 13 percent. In 2009, the population was estimated at more than 1,200 wolves in the U.P. and Wisconsin.
"Under the criteria set for Michigan for a viable population, a winter population that maintains a minimum level of 200 animals for five years and is federally delisted could then be removed from the state list of threatened and endangered species," said Mattson.
Biologists for the Arizona-based Center for Biological Diversity say the few, isolated pockets of wolves that have been nursed back to recovery are not enough, which is the reason they are asking the government to return wolves to suitable habitat across the country
