Confusion reigned as to who has the final say in the appointment of a new Chief Justice, even as the vetting commission, the 9 member Judicial Service Commission, was sworn into office. A member of the Commission, Ahmednassir Abdullahi says the President may make the appointment without involving the Commission, but Justice Minister Mutula Kilonzo is of the opinion that such a move would injure the spirit of the constitution. And as Hussein Mohamed reports, this may be the first challenge the Commission will face as it seeks to bring credibility into a tainted justice system.
