The Unite the Right rally in Charlottesville was planned, and the permit to assemble at Lee Park on August 12 was applied for and granted, months in advance following the first Charlottesville rally. A week before the event was to occur, the Charlottesville City Council rescinded the permit to assemble at Lee Park and instead told event organizers that they were to move the event to McIntire Park a few miles down the road. Jason Kessler, the event organizer, was joined by the American Civil Liberties Union, the Charlottesville-based Rutherford Institute, and Kyle Bristow in filing a lawsuit in order to have the permit reinstated. At 8pm, August 11th, a federal judge ordered that the permit to hold the rally in Lee Park was granted. This was a major victory for us. On top of this, the designated speakers were not being allowed into the space where the audio equipment was waiting for them to make their speeches. Event organizers spoke with law enforcement multiple times, asking them why they were not being allowed to enter the space where they already had a permit to assemble and speak. Leadership, speakers, and organizers were consistently given the runaround by law enforcement, stating that they were waiting on word from Charlottesville Police. Half an hour later, a Charlottesville Police Captain appeared and began telling rally attendees, “By order of the Common Wealth, this has been declared an unlawful assembly. You are required to leave the area. If you do not, you will be arrested.” Confusion swept over the crowd as many wondered if they should leave as ordered, or stand up against a clear violation of their Constitutional and Civil Rights. As most of the crowd began filing out of the park, Nathan Damigo, Founder and Leader of Identity Evropa, stayed and was arrested for refusing to follow an unlawful order that violated the federal court’s injunction. However, he was soon after released, taking to Twitter to let his followers and supporters know of his illegal arrest. Nathan immediately contacted attorney Kyle Bristow and they discussed raising funds in order to file a law suit against the City of Charlottesville for violating Nathan’s 1st Amendment rights.
