Illinois DUI lawyer Steve Fagan answers: How can I get my driver's license back after a statutory summary suspension for an Illinois DUI arrest in Chicago or the suburbs?

When arrested for DUI in Illinois, the police officer will typically take your plastic driver's license to hold as part of the bond in your case. That's not the important part - your physical driver's license is just a certificate that demonstrates you can legally drive. The important part is the Notice of Statutory Summary Suspension you were given by the police officer. This is true whether you were arrested by the Chicago police, the Illinois State Police, the Naperville police or any police department in Illinois. A copy of that document is then sent down to the Secretary of State, who enters a suspension of your driving privileges to begin 46 days later. That suspension makes it illegal for you to drive, and you can face misdemeanor or felony charges for driving on a suspended license in Illinois.
