When it comes to separating local law enforcement from federal immigration, Santa Clara County got it right not once, but twice. Now ICE wants to implement the Priority Notification Program – “PEP COMM” which is Secure Communities in disguise and in fact, worse.
Immigrant rights advocates and immigrant communities (united as the FIRE Coalition) stand together in strong opposition of efforts by ICE to undermine the trust between immigrant communities and law enforcement. Santa Clara County has been a beacon to many jurisdictions in the nation when it passed a policy that completely disentangled local law enforcement from federal civil immigration enforcement. Detainers violate Fourth Amendment Protections and local law enforcement recognize the harm to the community’s safety and trust when their agents double as immigration enforcement.
Our county has always upheld the values of inclusion, believes in equality and that there shouldn’t be a two-tiered system of justice based on one’s immigration status. The County and community groups have worked hard to establish trust between law enforcement and immigrant communities. Any engagement with ICE would move us backwards. ICE, which has proven to be as unaccountable as it has been deceptive, should not control our County’s criminal justice system.
