we have exclusive video that shows police officers hitting and tasering an immigrant in rio arriba county... this morning a judge dismissed the case against the man- who police say got violent with them. gadi schwartz is live with a story you will see only on 4. this case was scheduled to go to jury today- but a rio arriba county judge dismissed the charges- because the officers never had a warrant- here is the dashcam video of what happened. in october- criminal agents showed up to the home of julio caballero- over a dispute about money between him and the man seen walking with police. after showing officers his license- caballero starts to put some money back in his pocket... as caballero is taken down he asks over and over why agents are arresting him- and why they are taking his money. caballero has his head slammed in the ground- is hit with a flashlight and punched. you can then see caballero try to push an officer away with his leg- officers used a tazer multiple times while he was handcuffed. while the man who called police watches on. when caballero is taken to the police station- he asks about his money again... his attorney says this time an officer kicks him in the groin off camera while still handcuffed. you going to follow directions now? yes sir ahhhhh oohh aaauuough..... we are told caballero was given back his money- the acting chief of state police say he is aware of the video and internal affairs investigators are now looking into what happened. caballero's is considering a civil suit
