HARRY HOUDINI OR COPS ARE LYING read description...

6:30 p.m.: Billings Police Chief Rich St. John said that the man who died after trying to drive off in a police car after an hours-long standoff with SWAT team members on Sunday was initially placed into the BACK OF THE POLICE CAR with his HANDS CUFFED BEHIND HIM.

The 29-year-old Billings man, whose name has not yet been released, somehow managed to either free his hands or get them in front of his body, St. John said in a Sunday night press conference.

The man then apparently MANAGED TO CLIMB OVER THE PROTECTIVE CAGE and into the front seat of Officer Dave Punt's patrol car.

The man backed the car into a the yard of a home on the south side of the 800 block of Miles Avenue and struck a tree before putting it in drive, St. John said.

He then allegedly struck Punt with the car. Punt got up and fired a number of shots at the car as it sped westbound on Miles Avenue.

St. John said the car struck two vehicles parked along Miles before stopping.

Officers giving chase on foot arrived and saw that the man had been wounded and removed him from the car. A SWAT medic tended to the man until medical crews arrived.3:30 p.m.: Brian and Nancy Bersuch were sitting in their van across the street from a house on Miles Avenue when a man died after trying to steal a Billings Police Department patrol car.

The couple had been listening on a scanner to a standoff unfold around 9:30 a.m. at 807 Miles Ave. They were on their way home from Wal-Mart and decided to stop and see what was happening.

As they watched Billings police officers lead a man and woman peacefully from the house after an hourslong standoff that involved the department's SWAT team and at least one trained negotiator, they decided it was time to leave.

"They had the woman sitting on the front bumper of one of the new patrol cars," Brian Bersuch said. "They had the guy farther up the street and they put him in the back of that car."

He said they watched the police officer get into the front seat and then get out. Bersuch turned to his wife for a moment and when he turned back, the police car was gone. He watched it back into a yard on the south side of the street before he yelled to the officers, "He's stealing the car!" INITIAL REPORT: The 800 block of Miles Avenue is closed to traffic beginning at Eighth Street West.

Nine Billings police cars and BPD special operations van as well as an ambulance are in the vicinity of 807 Miles.

Neighbors who live on the eastern half of the 800 block of Miles Avenue said they were asked to leave their homes at around 9:30 a.m. on Sunday.

Officers on scene are wearing body armor.
