Can a system be considered liable? A lot in technology is coming: in transport in general, in aviation in particular. The way in which automation is supporting human performance is going to change. This will bring about a new allocation of the decision making tasks between the human and the machine: tasks previously carried out by the human are supposed to be partially delegated to the system. Does the integration of higher level of automation imply any change in the responsibility of the actors involved? Who is to be held responsible for the decisions of the automation? The Legal Case methodology intends to start addressing these questions, focusing on the topic of liability and automation for ATM systems.
