These can include the intentional torts such as battery, assault, trespassing, and can also include unintentional torts such as negligence. In order to recover from the defendant, the plaintiff must prove that damages were sustained. This can be something like a loss in property value, or it can also mean physical or emotional injuries. These physical injuries may take the form of what's known generally as pain and suffering. Since pain and suffering is subjective depending on the victim, the dollar amount that can be recovered for these injuries also varies wildly from case to case, and may also be limited by law in certain jurisdictions.
