Derek Francisco was charged with cultivation, possession and possession for the purpose. He filed his POLCOA Prohibition of charges then got his exemption and arguing it proved it was sick at the time turned down 1) plead guilty to only possession and you'll get house arrest, 2) and your equipment back, 3) and your marijuana back. And he refused saying he wanted a complete walk or find out if the law was really dead. So they withdrew all charges and gave everything back. Now, when anyone is charged, gets an exemption, we use the Francisco precedent to demand everything back because they proved they were sick enough at the time of the bust by getting an exemption.
