At the DNA hearing in 2004, assistant state attorney, Jeff Ashton, tried to get a defense blood expert to agree that the 35 year old blood stain on Zeigler's shirt came about as the result of Zeigler performing a depraved sex act on the dead body of Charlie Mays. This video contains footage from a 1989 TV program in which blood expert Herbert MacDonell falsely claims that Tommy Zeigler beat his father-in-law to death. When the DNA proved he was speculating, MacDonell, following the state's line, came up with an even more egregious explanation for the blood stain. An excerpt from the transcript of the DNA hearing is included showing how Ashton, the prosecutor who flubbed the Casey Anthony trial, inserted the false accusation into the record. As the result of Ashton's lie, Tommy was assaulted by a guard at the county jail after the hearing and for that reason he is refusing to appear at the upcoming DNA hearing on August 19, 2011.
