Prop 8 -- What's at Stake In August 2010, the US 9th Circuit Court ruled that Prop 8 violates the 14th Amendment of the U.S. Constitution. The 14th Amendment, established upon the abolition of slavery, prohibits any state from enacting laws that infringe upon the due process and equal protection of its citizens. This ruling is being appealed December 6th with a decision announced in early 2011. Based on the merits of the case, there is a high probability that Prop 8 will remain overturned with marriages of male couples and female couples resuming. This federal ruling has huge legal implications nationwide. Emotions run high. Prop 8 continues to be the most contested initiative in US history.
