Albuquerque Police Officer Leah Kelly is now on paid leave after shooting a mentally-ill homeless man who allegedly brandished a spatula. Two days before, she and Officer Jennifer Jara came to the 4th Street Breezeway and arrested two men who they were said illegally giving free food to the homeless. In this video, you can see Kelly and Officer Jara threatening people and asserting the power to confiscate their video recording devices. I was finally arrested for refusing to hand over my video phone. Kelly's attempt to seize the phone in the absence of a warrant and in the absence of any charges or arrests is a clear violation of the fourth amendment protection against unreasonable searches and seizures.
