In this video from NBC news, the illegal red light camera lawsuit I filed against the village of Crestwood, Illinois is discussed. My name is Tom Zimmerman and I am a Chicago class action attorney. As you can see in this video, Zimmerman Law Offices filed a class action lawsuit in Illinois on behalf of all motorists who received red light camera tickets in Crestwood at the intersection of Cal Sag Road and Cicero Avenue in Crestwood.
The Crestwood red light traffic cameras automatically issued citations to drivers who did not come to a complete stop before making a right turn at the intersection. However, there were no stop signs or stop lights indicating that a right turn on red was illegal.
Zimmerman Law Offices filed a complaint to void over 56,000 red light camera tickets issued by the Village and to obtain refunds of the $3,000,000 in fines paid by the motorists.
Additionally, our complaint sought a judgment declaring there were no traffic control devices controlling the right-turn lanes on the intersection. We also sought injunctive relief so that the Village of Crestwood could no longer issue tickets for making a “right on red” at the intersection.
As of April 2019, this class action lawsuit is still pending in courts. The Village recently filed a motion to dismiss our lawsuit which was denied by the judge who found that there were sufficient grounds to proceed with the case.
