Have you been arrested for DWI in Texas?
Have you been arrested for DWI charges in El Paso Texas? This video presentation will help you better understand the process when facing these charges. You've been arrested the arresting officer must confiscate your Texas driver license at the time of the arrest. At the time of the arrest the officer should issue a Notice of Suspension and a temporary driver permit. Thereafter you need to request a hearing to contest this license suspension. This allows you to continue to drive until your hearing. At your hearing you should request an essential needs license or occupational license. This allows you to drive for your occupational needs . This is an overview of the trial process. You will thirty days after arrest will be required for a first appearance in court. Generally an attorney can attend in your place. Next comes the Pre-trial conference. This is generally occurs eight to ten weeks after the first appearance. In this opportunity is where your attorney and the county attorney discuss the best resolution. Six weeks to three months after the Pre-trial conference is a suppression hearing. This is where your attorney will file motions to suppress some or all of the evidence against you. The next step maybe a trial. Not all cases have reached a trial. If you reach a trial in your case it maybe a bench trial or a jury trial. The next step in the process is sentencing. This is imposed after a conviction or a plea bargain has been accepted. Sentencing can include jail time, fees and fines, community service and alcohol education classes.
We hope this presentation has been a useful introduction for the DWI trial process in El Paso Texas. For more information on how to protect yourself on facing charges in El Paso please visit dwielpaso.com. Thank you
