Yes, but once Kagan is on-board the SCOTUS will bring it up for vote again, especially with a push from Sotomayor, and go the other way since Sotomayor is 'now' unable to locate where it says so in the Constitution

Today it was 5-4 but it will go 4-5 with Kagan ^_~

I wouldn't hold my breath as whether Congress would uphold their swearing to the Constitution; that doesn't appear to be the case for some time now.

I do hope the Senate will lose the Dem majority but that's doubtful; the House though will or should have quite a few new seat-dusters

I too would like to see all of the ONE's records unsealed so they can be reviewed
