You didn't answer my question. Was the cop just supposed to let the guy go because he didn't want to comply with him? Is drunk driving a crime? I suppose in your world the guy would have to run over a kid before he "actually broke the law" and then keep driving for a month waiting for a judge to convict him so they don't "violate his constitutional rights"? The guy refused the test knowing he wasn't going to be let go so why did he fight? I'll ask again, was the cop just supposed to let him go?
