Sonia Sotomayor is a federal judge on the U. S. Court of Appeals for the Second Circuit and is considered to be a leading candidate to replace retiring Justice David Souter on the U.S. Supreme Court. In this video she makes the argument that judges make policy.

Courts of Appeal can legitimately "make policy" consistent with judicial precedent and legislative acts. Most statutes have open-ended language that requires a judgment on how to apply the rule to specific facts. Often, the law requires the court to balance competing factors (eg, the interests of a state employer vs. an employee's 1st amendment rights). This cannot be done without brining policy preferences to bear. Conservatives and liberals who practice law, or follow the courts, know this.

ok. let me give you a concrete example. You know that it is a POLICY in the U.S., that black and white students cannot be separated in public schools based on race. That is a POLICY BECAUSE of a COURT CASE called Brown vs. the Board of Education that was decided by JUDGES. Before that case, that was NOT a POLICY. You can continue to say that I am wrong. But if you do, I have one word for you . . . DENIAL!!
