What do you consider to be "menial crimes?" I think in some cases it should be based on the victim. What I consider to be a menial and insignificant criminal act may have greatly impacted someone elses life. To triviolize something isn't always the correct way to deal with it, and its a proven fact that for some of the "menial" crimes, that is only the start of a long term life of crime.
