  • A great argument for "you can beat the rap but you can't beat the ride".

    Oversimplified answer is think of it as a disincentive to engage any conduct which puts you in jeopardy of arrest, search and seizure. Second, and far more interesting legal point, is who is the "but for" cause of the fraudulent warrant or unjust arrest, search and/or seizure to be held accountable and financially responsible?
