Danny Myers was unjustly sued by a client for a simple, fixable mistake. "It kind of puts a damper on the American Dream, thinking that everybody is honest and fair, and it doesn't always work out that way unfortunately." Part of the FacesOfLawsuitAbuse.org campaign.

  • Why can't the judge have a moment of commen sense and say either you get the pool repaired at no cost or you get nothing!? This sounds like another rich tight ass wanting something for nothing.

  • All I have to say is if you make a mistake you have to pay for it. Even if this guy says he will fix the pool there is no guarantee that it will come out the way it way suppose to. Do the job right and these things will not happen.

  • the guy saw a great opportunity to scam this guy, "hey, im supposed to get 6 feet, but he only did 5, oooh wait, its already built at 5, i dont really care now cuz i can try to sue because i was supposed to get 6 and see if can get a free pool out of this"

  • This isn't abuse. This is how the courts should work. If I'm speeding and the officer doesn't show up to court, hey I get off scott free. But NOBODY complains about that now do they?

  • Danny's lawyer sucked. This is a first year law school contracts case and any lawyer dealing with a contract issue ought to know that ALL a plaintiff can get from a contract suit is damages to compensate the plaintiff for the loss. $20,000? Total crap, especially given that Myers offered to fix the mistake. The lawyer sucked - he should have at least made a counter-offer to that figure. He just didn't care because this case wasn't worth any $ to him.

  • If Danny Myers' company made a mistake (which they did), it was avoidable from the very beginning. Maybe you should train your employees better? Mistakes mean your customers didn't get what they wanted, what they paid for, what they deserved!!! Having to take a co. to court to get relief is a constitutional right! Maybe you'd rather have a different system where there's no lawyers - whoever's biggest wins?
