So what did the High Court decide?
Both the taxpayer and the ATO were upset with the lower courts decision in Bamford. (Ed. as is often the case when you waste money going to court). The High Court granted Special Leave to both the taxpayer and our friends at the ATO to appeal the Federal Courts decision in Bamford. What is Special Leave? All this means is that the High Court has agreed to hear the appeal at some future date. The High Court, being the highest court of the land, can choose whether or not to hear such matters. It has discretion.
