A punitive demand placed on the victim but no punitive action taken against a firm placing 8 washing machines 30 foot high, the mind boggles, on the type of judges we have today in the UK.

This accident nearly killed 2 people, the negligence by the company in putting 8 washing machines on the highest racking reaching up to 30 feet with insufficient wrapping and this case was brought to the London County Court for judgement?

County Courts
County Courts are statutory courts with a purely civil jurisdiction. They are presided over by either a District or Circuit Judge and, except in a small minority of cases such as civil actions against the Police, the judge sits alone as trier of fact and law without assistance from a jury. County courts have divorce jurisdiction and undertake private family cases, care proceedings and adoptions.
County Courts are local courts in the sense that each one has an area over which certain kinds of jurisdiction—such as actions concerning land or cases concerning children who reside in the area—are exercised. For example, proceedings for possession of land must be started in the county court in whose district the property lies. (1) The official Solicitor "May Maughan" be appointed as the litigation friend. Claim Number 6ED03566

We will be going to court on the 30th June for the court to approve my wife's settlement of £166,250.

The court has also to decide whether or not she is a "protected beneficiary"?
I will have to do another video explaining more.

  • @whotaughtyou. Do we know each other, because your statement RAF 1972 rings a bell to me the year I left the RAF, were you station at RAF Henlow?

  • (Cont.) My own experience with expert witnesses is that you may well get a retired expert who may not be up to date with the literature so they must be questioned by your representative who is more clued up with precedents and other latest relevant information.It all comes down to Justice being held to be blind. If you bring an action against someone, you have to demonstrate your case such that you would convince an objective person (referred to as"the man on the Clapham omnibus".)

  • @Wingandaprayeruk It's funny you mention a retired expert witness, that is exactly what our solicitor obtain, he discarded the expert witness report from Oxford hospital who ran a private surgery there and was extremely efficient, our solicitor totally ignored his recommendation and obtain a retired expert instead. I think you don't realise that you have to pay your solicitors bill if you decide to dismiss him. We had to dismiss 2 of them.

  • It has been eight years since the accident and my wife is still waiting for her compensation to be paid out, if you are interested I have provided a link above to my hub page ( In description) that brings this case up to date on our circumstances. We have our MP Andy Love trying to bring this matter to a close; he has taken extremely long to obtain information from the authorities involved.

  • @Wingandaprayeruk . We were boycotted by our second solicitor Vendorpump & Sykes in Enfield, They left the decision to the last hour before telling us that we had to except the defendants expert witness report which was totally false, we refused and the case was thrown out of court. We had to get the Law Society to make Venderpump & Sykes obtain a barrister to have the case reinstated.

  • (Cont) There is nothing to stop you advertising for other people who have suffered similar incidents at Costco or who know more about incidences of neglect of duty of care towards customers, if your representatives have not already done that.

  • (Cont) Did you get witness statements taken from people who witnessed the incident but who will not benefit in any way from any compensation, so could truly be called independent witnesses?The Defendant(Costco) have a reason to defend their position of assumed duty of care towards customers. Imagine you are in their position for a minute and you can imagine the stunts they would pull to try and avoid putting other customers off. Doesn't make it right, but that's what they will do.Best wishes.

  • Dear Colin; You must not take it personally that the court system works in this way, even though it seems so unjust. The same process would come about if anybody else brought an action but you must not think that the process has been changed to prejudice you personally. It doesn't work like that. You have information on a number of sites. Apologies if I have missed some details and ask you questions that you have answered elsewhere.Expert witnesses have to be agreed by both sides beforehand.
