Just because the results of your blood or urine test show a blood alcohol level at .08 or more does not mean you are guilty of DWI/DUI. There are many challenges to the procedures that can result in getting the test thrown out of evidence or creating reasonable doubt for a jury, including a retest of the sample.   • Thats why breath is taken almost all of the time instead of blood. By the time you get to the hospital ,and get waited on your person is close to being sober.

  • i am in the state of Illinois and I asked for a lawyer. Was refused. Warrant was issued for a blood test.. Never saw the warrant, never saw a lawyer.
