air pressure pushes water into the pipe. since there's only water in the pipe, when the water moves through it and goes downhill, there's a vacuum left behind it and air pushes more water into the pipe to fill it. that's how water flows uphill on the inlet.

How deep does the inlet pipe have to be? Or does it just not matter?

No what they do is place the pip into the pond, and the other end down hill to the spill point. Then attach a temporary pump to this down hill end, suck up water until it hits the pump and then detatch it. Once the water starts to flow it will continue on it's own accord.
The Romans used a similar principle when building Aquaducts for pushing water up the side of a cliff. Except they had manual pumps to get things flowing.
