A landspout is considered a tornado. Even then Normal tornadoes can form over water or move out on to it.

kay but in human terms its officialy a tornado if it some ashore

not really. They're separate and form from different cloud structures. They're more likely to be called a landspout.

Waterspouts that are not associated with a rotating updraft of a supercell thunderstorm, are known as "non-tornadic" or "fair-weather waterspouts", and are by far the most common type. They usually rate no higher than EF0 on the Enhanced Fujita scale, generally exhibiting winds of less than 30 m/s (67 mph).
