Accused child murderer's trial moved to Montgomery County

HENDERSON — The trial for a Rusk County man accused of murdering a 13- month-old baby during an exorcism will be moved to Montgomery County.

J. Clay Gossett, judge for the 4th Judicial District Court in Rusk County, announced Friday that Blaine Keith Milam will be tried elsewhere because he likely could not get a fair and impartial trial locally.

Gossett, in a news release, said he and his staff "will accompany the case to Montgomery County" and jury selection is set to begin Jan. 19, 2010. The case will be prosecuted by district attorney Micheal Jimmerson's office.

Milam and his girlfriend, Jesseca Bain Carson, who is the mother of the child, were both 18 years old when the alleged crime occurred on Dec. 1, 2008. They will apparently be tried separately. No date or venue has been set for Carson's trial.

Milam is accused of killing Amora Bain Carson in an attempt to exorcise demons.

At the time they were arrested, investigators called the scene "horrific" and said the child was "obviously dead" when emergency personnel arrived at the couple's Chalk Hillarea home, according to RCSO Lt. Reynold Humber.

Milam and Carson were immediately arrested and incarcerated in the Rusk County Jail, where they have remained with bail originally set at $2 million each.

Before a gag order was issued in the case, Humber said the crime probably lasted 11 or 12 hours, during which time Milam had placed the baby in a bedroom and the mother was not allowed in, except once, while he was "supposedly performing an exorcism on the baby."

The child was described as having severe trauma to her head and 15 to 20 bite marks all over her body, the investigator said, adding the baby was struck with "numerous objects including a hammer."

"(The mother) was in different places in the house, like the kitchen and the living room. She could hear all of this going on. (Milam) told her it was the different voices of the devil coming out (of the baby)," Humber said.

At first the couple told several different stories to officers, alleging the child was involved in a car accident, bitten by dogs, left alone and someone else attacked her, and even that she hit herself with a hammer, before the mother admitted their roles in the baby's death.

About a week after their arrest, Bob Richardson, Precinct 5 justice of the peace, issued a gag order on all involved in the case.

Milam could face the death penalty as Texas law states capital murder charges are applicable when the case involves a child under the age of six.

Milam reportedly had a previous conviction in Gossett's court for second-degree felony criminal solicitation of a child. He was accused of leaving obscene notes in a 13-year-old girl's bedroom that described sexual acts he would like to perform on her and "going through her underwear drawer." Milam was sentenced to 180 days in jail as part of the probation conditions agreed upon on Aug. 22, 2008. Published reports in December indicated the teen served 48 days on work release and "then stopped returning."

Milam was also prohibited from being around children except his own biological children or siblings and Amora Carson was not his child.

Officials said Milam also failed to register as a sex offender in Rusk County and had not changed his previous address from Longview.
