if u have it jailbroken then download this app - activator. it has shortcuts like if u touch the status bar for 2 sec it will be like pressing home or if u shake your ipod it will be like pressing home button

If u message apple theyl make u pay 150$+ just for them to check it, then ull hav to pay for the parts, im srry to say but it seems the circut (or) spring thts under the home buttn is broken:[ if its jailbroken try restoreing it by puting in DFU mode.
