Huber appears in court
Judge won't reduce bond for former police chief
Nov 14, 2007
[Excerpts] ...The charge of first-degree murder carries a maximum penalty of life in prison without the possibility of parole or execution, Anderson said, and the alternate charge of first-degree manslaughter could result in a maximum penalty of life in prison. Mike Butler, [Ken] Huber's attorney from Sioux Falls who recently represented Sen. Dan Sutton, asked the judge to consider a bond reduction so Huber could continue medical treatment he began during the approximately 9-day span between his wife's [Pam] shooting and his arrest... Huber checked himself into a VA facility and was under a doctor's care at the time of his arrest... Butler said his client is not a danger to himself or anyone else and the shooting was an accident, which is why prosecutors have filed the alternate manslaughter charge. "The only eyewitness made the statement that she believes the shooting was an accident," Butler said, referring to the couple's daughter who was reportedly lying in bed with her mother when the shot was fired. "My client said in the 911 call that it was an accident"... Assistant Attorney General Bob Mayer said the state believes the defendant is a danger to many people and the bond should possibly be raised from $500,000 cash to ensure Huber stays in jail. "Well, I'm not going to reduce the bond," [Circuit Judge James] Anderson said. "Since both charges carry a sentence of up to life in prison, he might decide it's better to take off rather than show up in court. But I'm not going to raise it either"...
