@Latchet21 King cannot move into check, that would be an illegal move, and taking that pawn that was guarded by the opponent King, would be an illegal move as that move would put the King in check by the opponent's King.
A checkmate is to put the opponent's King in check where he has no where to go, no piece to block it, or any way to capture the checking piece. In this case, he is NOT in check AND he has no more legal move and thus the result is a stalemate.

@Latchet21 well, the black king would not be engaged in an attack by any peice. therefore it would be a draw.. but i would think adding up the value of all peices should mabe be cauculated in a draw.

It can only be check mate if the king is first in check. Black is not in check here (had to do some research myself to figure that one out :P).
