5 cruisers show up to my house while my sons little league team was doing batting practice. Seems a little excessive to hand deliver a note from Chief Bailey. Called Chief Bailey to ask him why the cavelry was required to deliver a letter and he indicated to "mind my own $##@^% business and he would run his department as he wanted". Called Lt. Doudi who said they made a mistake. Filed a complaint against Chief Bailey with the Town Council but it was ignored. Attempted to present complaint at the next town council meeting, however, Chairman Paul Roy indicated that I could not present during the public comment period allowed by state law. I asked that Roy be disqualified since he was a police officer who reported to Bailey and he declined. Town council ignored my complaint and refused to allow me to be heard regarding the continued police harrasment. Roy violated my constitutional right to free speach. It is well documented that I asked Chief Bailey for a written apology for sending 5 cruisers to my home, however, he refused so I was forced to file a lawsuit. How quickly the Chief forgets that I had helped his officers apprehend a woman at Walmart who was attempting to flee the parking lot after being confronted by store security. "I was pretty much right there when it happened," he said. "The call came into dispatch, and went out to me after dispatch lost contact with Wal- Mart."

As Bothwick approached the store in his cruiser, he saw Wal- Mart Loss Prevention Officer Amanda Pratt struggling with alleged shoplifter, Darlene Schneider, 41, of Manchester.

He yelled for her to stop, for her to unlock the door.

"As I was calling in the plates, she began to slowly back out from the parking spot, with me behind the vehicle," he said.

Though Bothwick was not struck by the car as it reversed, he was injured as he broke the car window. Bedford resident Brian Lamy saw what was happening and assisted the officer.

"I broke the window with the base of my radio," said Bothwick.

"The assisting citizen reached for the keys and pulled them out of the ignition, and I grabbed her arm and pulled her out.

  • Actually if you read the law.. law enforcement is immune from that law and it even breaks it out in definitions if they are conducting an investigation and based on the video he was conducting an official investigation in the scope of his normal duties... There may be more to this that I don't know but im just commenting on the actual video portion you have posted...

  • @mrdallas1974 there was no investigation. The 5 cruisers showed up to my house to deliver a letter from the chief which could have been mailed with a 44 cent stamp. Would you think it was normal for 5 cops to show up to your house to deliver a letter?

  • Ok...You weren't searched or seized at any time and when you asked them to leave your property they left so Im not sure why your referencing the 4th amendment.. And I HAVE SERVED MY COUNTRY and don't get the reference there either... But good luck!

  • @mrdallas1974 so you have no problem with the police coming onto your private property and filming you without your consent? In NH it is called "wiretapping" and considered a felony. No different than the Bush admin. listening to your phone calls without a warrant.

    I had no idea I was being taped until I filed a right to know request and rec'd a copy of the cruiser cam. Their own policy says that are supposed to tell me. See NH RSA 570. I have no problem with taping if they told me 1st.

  • @mrdallas1974 Read the Forth Amendment to the United States Constitution. Ask someone who has fought for our freedoms and they will explain why police shouldn't be able to come onto your property and videotape you without your knowledge.

  • I laugh at the obvious LEOs commenting and downvoting here. Most LEOs are very professional and follow through their days as they are expected to. However, there will always be a few bad eggs. Bedford is no exception. To the LEOs posting here: stop making LEOs look bad.

  • @pbhclan I have read the fourth amendment many times, you obviously are misinterpreting it for your own benefit. Trust me now.... those police videos are there more for YOU (ie US) then they are for the police. They are more likely to get the officer introuble than you. Sounds like you were driving with a suspended registration?? Don't be a douche. just pay your fines annd you wont have anymore problems.

  • @pbhclan umm. It's only a felony if they use it as testimony to charge you with somthing in court...they dont need permission, they only need to tell you you are being recorded. Anyone can film all they want without permission otherwise security cameras would be illegal. hence all the "These premises are under video surveillance" signs in walmart. Did you actually read NH RSA 570? or did you read just the part that you wanted to hear? thats usually what happens.
