It is ironic to see Rove complaining about the US turning into a "Latin American dictatorship", when he was involved in firing US attorneys for not being loyal enough to the GOP.
The key phrase here is "rule of law" and Rove is trying to spin it to where torture is a "policy difference" rather than purely unconstitutional. Of course the Bush WH always had a problem with the Constitution, and defined everything to meet their needs (like Cheney having his own branch of government).
