What happens if a credit card company sues you during debt settlement? Can they seize your bank accounts or garnish your wages? If so, when can they do this? Very important information if you are in a position where you cannot keep paying your credit card debts.

  • Just keep minimum cash in checking account.and tell them to "FUCK OFF".

  • As long as you pay "something" on your credit cards. They can't do anything to you. If your min payment a month is say $250.00. You can only pay them $50.00. You'll be fine. They'll bitch and moan, but in truth they'll be happy to get anything from you. I did this for over a year till i could get another job. If it comes down to buying food or paying a CC bill. Buy the food! And just send them anything you can at the end of the month. In today's world they'll be happy to get $10 instead of $0!

    Go to Debtor Boards Forum and learn HOW to defend yourself in court.

    Electing Arbitration is working for many, as it costs them $5000 to pursue it.

    Debts under that size arent worth collecting. Its just one strategy there are many others that work.

    The Banks by and large break the law every time they try to collect via FDCPA and FCRA

  • SOMEONE HELP that knows...I AM ON SSI....if i almost max out alll my credit cards and only pay them for 3-6 months and then pay 10 bucks a month then stop after 6 months or so( dont pay anymore to them)...would that be seen as fraud? i know they cant take away my ssi check, i have no money in the bank... could i go to jail?

  • I also wonder how uncommon it is to get sued by CC companies. Even tho some say its rare, if you visit online forums about credit card debt, there are usually many posts about people being sued.

    I'd like to know the basis for the claim that suits are rare?

  • While you are correct that they can sue you if they need a judgment, you are incorrect in that it is rare for them to sue. I have seen many cases online at Alameda County Superior Court and there are tons of collections lawsuits by MAJOR banks over some debts as small as $700. You ought to help people with affirmative defenses to combat the lawsuit because if they don't answer, default judgments can be taken out.

  • A court can't garnish your wages if you don't get to speak for yourself. They must prove standing. Also, if you call a credit card company and agree to pay anything you are now in a binding verbal contract. Don't agree to pay anything. That is why htey record the calls.
