To Harriet Harman MP (e.mailed today)

I have read the Times-Online article dated 2nd August 2009 reporting that you were defending the decision by ministers not to intervene in the case of Gary McKinnon so as to follow the important principle that Ministers should not make judgements about the criminal justice system.

...Considering Garys position within the context of his diagnosis of Aspergers Syndrome and, furthermore, the particular characteristics of his diagnosis (which I am not privy to), I think there is reason for ministers to be very alert, concerned and involved in what appears to be happening.

 To me there is a very strong sense that the proposed extradition of Gary and the possibility/likelihood that he will lose his liberty is disproportionate in the context of both his position in society as a disabled person and his Human Rights. I am well aware that Human Rights may be limited in some cases but, at the same time I think that the way this matter is being handled could be construes as both inhumane and degrading for a disabled person for which there can be no excuse.

 The volume of very welcome legislation supporting disabled people in recent years clearly has the long term aim of including disabled people into society as fully contributing, respected and equally valued members. Inevitably legislation, including, criminal justice legislation, will have to make accommodations for the step change in recent legislation that encourages us to see disabled people embraced and accepted within the norms of society. This is a hugely exciting prospect for disabled people but one where the criminal justice system may, in the short term at least, grapple to accommodate the particular characteristics pertinent to disabled people. It is, to my mind, essential in this case that there is a very clear understanding of Garys world view as a valued and respected British citizen with Aspergers Syndrome and how this extraordinary case may demonstrate the limitation of criminal justice laws that did not acknowledge the plight of disabled people as valued and respected British citizens when they were drafted.

 In this story there is also a strong sense that our American friends have been caught with their pants down by a lone man with Aspergers Syndrome who had the audacity to hack his way (as I understand without too much effort) into the USA national security IT system. One has to ask if the USA is accepting due responsibility for its apparent lack of security and now, in a rather bullying way, is seeking a whipping boy to slake its embarrassment? I think quite rightly some people (cf. Any Questions 30th July 2009) have pointed out that Gary has done the USA a big favour. Better Gary than Al Qaeda and it would be big of our American friends to admit their foolishness.

In short.I think the case of Gary Mckinnon carries with it principals that Ministers should be very concerned about and that, in my view, there is a need for the Government to step in to defend Garys rights if the criminal justice system is not currently adequately equipped to deal with this case in a humane way. The Government has made a few foolish blunders recentlythe Ghurkhas, compensation for wounded members of the armed forces etc. Please do not allow this to become yet another.

  • The prison sentence the US justice department is seeking - should Gary be successfully extradited - is up to 70 years. Gary's case has attracted attention due not only to the controversial sentencing and extradition but because of his claims that he found evidence of deliberate airbrushing of UFO-like anomalies and documents mentioning 'non-terrestrial officers' and space-based 'fleet-to-fleet transfers'

  • In February 2007 his lawyers argued against ruling in an appeal to the High Court in London, which was turned down in April. He still has the possibility of appealing to the House of Lords using the argument that because the alleged offences were committed in the UK this is where he should be tried.

  • Gary McKinnon is accused by the United States of perpetrating one of the "biggest military computer hacks of all time." Following legal hearings in the UK it was decided in July 2006 that he should be extradited to the United States.

  • For Gary McKinnon thinking of you always
