Custody Visitation
In a divorce case, the most important thing that parties have to decide is what the arrangement will be for custody and visitation. Both parents to should make this as easy as possible for the children and let them know they are loved and cared for by both parents.
In North Carolina, in the even that parties cannot resolve their dispute, one or both parents may file a claim for custody for the court to decide. Both parties will be required to work with a trained mediator before the case is put on the court docket. If an agreement is reached in mediation, it will be reduced to writing and entered to the court after each party has time to review the document with their attorney. At trial, the court may grant joint custody or exclusive custody to one parent. The judge (not a jury) will decide what the living arrangements will be.
In North Carolina, an order for child custody may be modified.
