The law in California says a shopping mall is a "non-traditional public forum" where free speech is allowed. But banging pots is not really allowed either. People have to not disrupt the business while speaking. I am not sure about the law in Oregon, the US Supreme Court backed California law, but said it was not a Federal right, ie, depends on the state's law.
Malls are not public, and anyone the owners deem inconvenient can be legally ejected. This is why there's no money for parks. Parks are public space and anyone can gather there and there's no profit involved. So parks have to go, and the only space for people to gather is a mall, where the only purpose is to generate profit, and all that pesky constitution stuff stops at the door.

Untrue, USSC has ruled the malls constitute a 'public square' as far as first amendment rights are concerned.
