  • Judges decide and mediators facilitate. HUGE difference!

  • The comparison between mediator and judge is misleading in that a judge tells the parties what to do. That is the roll of the judge. Judges do not facilitate they order. Mediators never order, they only facilitate. There is a BIG difference between those roles and just the word Judge, brings up a lot of images that are not related to mediation. I think it is an unfortunate use of the word judge.

  • So a judge is not a neutral party who facilitates the process?

  • A mediator is NOT like a judge. A mediator is a neutral party who facilitates the process.
