From CBC Newsworld, Thursday February 8, 2007. The Ontario Court of Appeal decided to overturn their earlier 2005 ruling which made Ontario homeowners responsible for all registered mortgages on their property, even fraudlent ones like the one Maple Trust registered on Susan's home. This was a significant legal victory for homeowners. The ruling itself is at http://www.ontariocourts.on.ca/decisions/2007/february/2007ONCA0074.pdf

  • BTW, good for Susan!

  • Oddly enough the Ontario court making a fraudulent transaction valid sounds like a, "only in Canada" case. I've lived in Germany and USA this kind of thing just doesn't happen. In either place if a bank makes a loan based on fraud it's on the bank. The bank THEN has the right to pursue those committing the fraud, not the victim.
