A federal judge in Florida recently struck down the state's strict limits on lawyer advertising. The state rule had prohibited "manipulative" ads, including the use of "any background sound other than instrumental music". The issue came to fore after the state bar deemed a Jacksonville attorney's proposed slogan, "Don't settle for less than you deserve", as overly laudatory. The Court felt the restriction on "manipulative" ads was so vague it violated lawyers' First Amendment rights. The judge likewise struck down the ban on background sounds. In honor of this moment, I produced the following parody advertisement using public domain footage from the famous "Odessa Steps" sequence from Battleship Potemkin and various sound effects prohibited by the now overturned Florida advertising restrictions.
