I think it's fine to Water Board Unarmed Combatants. I believe it is torture by definition alone and that definition should change, the English language is constantly changing.

If it truly is torture, by definition, it has to be the least invasive and most humane 'torture' ever conceived. People have been Water Boarded on live TV and shrug their shoulders at the technique when all is said and done.

However either you or I don't understand the way your using the term "Grandfather Clause".

I suppose it could be used for ill purposes but everything I can think of is good. It protects the citizens from being unfairly 'burdened' by new laws when the clause is applied.
