Well, I know that there's a few members of the Bush Administration who are in the Kissenger position of facing charges if they leave the USA. It does set an uncomfortable precedent for many politicians to call a previous administration to answer for its actions in a court, as the same thing may be done to oneself if you are seen to "balls up".

Damned if you do and damned if you don't, it could be very divisive at a time when Obama needs to appear conciliatory. The public must demand it.
