She was terminated by Nortel within two weeks of returning to work after 12 months of maternity leave. Nortel did not pay her any severance and she was refused Canadian employment insurance benefits.
Tina Thomas was terminated by Nortel Networks in a downsizing involving a mass layoff of employees. Under Canadian employment law, Nortel is obliged to pay severance, but Nortel is hoping to escape paying severance by filing for bankrutpcy protection. This is a legal precedent setting case for Canada.
