Would BT, Virgin, CPW the three biggest ISP's in the country do something like this without out checking every last box on the legality front?
Yes, if they thought that they could pimp mine and other net users data to a company that has a history of pushing adwarez and rootkits.
Change your ISP today!
Let them know why you are changing!

This datastream is my property. You are not authorised to use my property without my permission. I have repeatedly contacted you to offer you the user of my datastream (opted in or opted out) at 1p per byte.
The truth is that you intend to use the private property of others to make money. You ignore people who offer to sell you the use of that property. How, exactly, is that legal?
Is it legal in the sense of nobody has been prosecuted for doing it? Simple yer or no will do.

How much will BT Virgin or Carphone Warehouse be paying me for my datastream? Without my data Phorm does not work. Withouth my datastream Phorm is not going to earn £85million for BT alone.

This is absolute proof that Kent did really well in his formal education in politics. The opt-out mechanism was recently labelled 'illegal'. This was after you'd received your business critical legal advice and proceeded with development. Now that it might affect the entire business model why are you still proceeding so agressively instead of doing a restructure of the technology? It's making a lot of serious people question your motives and trustworthiness. Trust is earned not demanded.

Wow, it all becomes so clear now, I've had it wrong all this time, silly me. If BT, Virgin and TalkTalk say it's ok, then it must be so.
I mean, they are so trust worthy, it's not like any of them would secretly test Phorm on over 30,000 of their customers without telling anyone, and then lie about it, and when caught try to claim that it was not illegal anyway. Oh wait.......
Does this guy seriously think that anyone with even half a brain believes what he is saying. You only have to take a look at what these people have been doing in the past to see that Mr Kent here is a walking sewer plant with an outlet for a mouth.
