Orly got slapped down - again - because she is completely incapable of following legal procedure. Hawaii statute 338-18 clearly spells out the legal documents required to get access to birth records - a subpoena is not one of them. Apparently clueless Orly thought the law didn't apply to her. When (if) she gets a hearing on 9/14, the Judge will tell her to get the required documents or go away forever. And round and round it goes...

@SpankyPinkbottom - You could very well be right. But, thank God for Orly. She is doing the work that at least ONE Congressman SHOULD do! NOT one congressman has gotten on a plane, flew to Hawaii and demanded to see the original and take doc experts with him. Gee...wonder why? Go Orlyyyyyyy!!!!!!!

"Releasing to the public" is not the same as complying with a court order. This excuse was nothing but bullshit.

Nope. Hawaii law clearly states that a "court order" is needed. A subpoena cannot compel a person to break the law. If the Hawaii DOH had complied with Orly's subpoena, they would have been guilty of contravening section 338-18, and could have been liable for prosecution. Orly needs to stop screwing around with useless paperwork, and get a court order. I'm sure she could find a conservative judge in Hawaii to issue one. Why doesn't she try that?

By US law, the actions of a parent can have no effect on the citizenship status of the child. The only way that Obama could lose his citizenship would be to renounce it in person at a US consulate after his eighteenth birthday. Unless that happens, the status of his father(s) is completely irrelevant to Obama's citizenship status.

For the same reason that Orly got slapped down - birth records are only available to a third party via a court order (NOT a subpoena). If any member of Congress tried to do what you described, they would be told exactly the same thing, regardless of who's BC they were trying to obtain. In essence, Orly's subpoena asked the Hawaii DOH to break the law - it just doesn't work that way. I don't understand why she doesn't get a Hawaii judge to issue a court order.

No - it wouldn't. Note the words "order of a court". A subpoena is not a court order. Orly needs to get her act together, and find a judge in Hawaii willing to issue a court order. A subpoena is just not going to work.
