To put it bluntly, the city system for land acquisition again failed with the Wiacek property, as it has with similar direct land acquisitions. Private land owners are rarely successful in selling land to the city even if it is for open space. In fact, to my knowledge, private land owners, who are not developers, are rarely successful in obtaining subdivision approvals from this administration, particularly if it is for more than a few lots. Possibly out of frustration, the Wiaceks applied for a subdivision to the P & Z and surprisingly, it was approved. Heavy construction equipment immediately cut an access path from Constitution Boulevard to the property but further development ceased when vandals cut the hydraulic hoses on the construction equipment. The BOA quickly approved eminent domain and used the Conservation Commissions listing of the property as Open Space as the reason.
