If you have watched the video of the cop who killed Oscar Grant you will see him look up and look down. The video was too obscure to see his expression but he looked amazed/surprised. Like "WTF, that taser just put a hole in his back!
I doubt he intentional thought "fire my weapon". I think he thought it was a taser gun. Even though a gun looks and feels differently.
There are reports that say they there is no difference in weight.
"The ADVANCED TASER M26 (Police version) is 19.2 ounces, the glock M26 which it is modeled after is 19.75 ounces (26 ounces loaded)."
I don't think they use Glock's. But still that is a weighty stun gun.
Even if it was a mistake why would one Bart Official say there was no video and the next say, the video does not show the gun going off?
Not smart. Specially when we have all seen what happened, though it might actually help the police explain how this was an "accident" if there was a better video of the jack ass cop who decided his life was being threatened even though he had 6 of his buddies around.

I fear this is going to end up the same way the Rodney King riots did. Especially if the cop is found innocent. And there is the argument of weather he was restrained or not, not that that matters.

BART Police Officer Johannes Mehserle.
Five officers had gathered at the Fruitvale BART Station platform when the train arrived shortly after 2 a.m., Allison said.
According to Mike Yost, supervising coroner investigator with the Alameda County coroner's bureau, Grant was pronounced dead at 9:13 a.m. at Highland Hospital.
Three or four people on the platform were put in plastic handcuffs, called "flexi-cuffs," during the effort to bring the scuffle under control, Allison said. While Allison stated Grant was not in handcuffs when he was shot, police said it is unclear if Grant had been cuffed at any point before the shooting occurred.
"A preliminary investigation indicates that Mr. Grant was not restrained when the officer's firearm was discharged," Allison said.
Grant was unarmed and no weapons were recovered at the scene. Authorities said they were still investigating whether the gun was fired on purpose or accidentally.
The BART spokesmans version of events stands contrary to the claims of some eyewitnesses to the incident interviewed immediately following the incident. Several witnesses who did not know Grant told KTVU they saw him lying on the ground ALREADY restrained when the shooting happened.
"He had the zip ties around his ankles and wrists," claimed one witness.
Grant was transported to Highland Hospital and underwent surgery, according to family members.
Grant's family says his lungs were damaged in the shooting when the bullet went through him and then ricocheted off the ground and re-entered his body. He leaves behind a four-year-old daughter.
KTVU spoke to one young man at the incident who says he got the entire shooting on tape. He says BART police confiscated that tape, but says the video shows the officer pull his gun and fire two or three seconds later.
BART police patrol bureau Cmdr. Travis Gibson said it is too early to determine the justification for why the officer took his weapon out of the gun's holster.
The last fatal officer-involved shooting at a BART station occurred in April 2001, when an officer at the Hayward Station shot a man who later died, according to Allison.

Haaaa. yeah it seems that way. If this guy gets acquitted like the cop who beat Rodney King.. because there wasn't "enough evidence" SF is going to erupt in violence. This was much worse. I hope the Bart cops realize this.

I just wish in these circumstances they would be absolutely truthful. Its not like we need more video but the guy did look a little freaked out after he fired.
Diplomacy can go a long way.. Something we have yet to learn
