Consumer attorney John Watts discusses the critical step of obtaining a statement from a third party (co-worker, neighbor, family (except spouse), etc) who has been contacted illegally by a debt collector.
It is important to document the illegal third party contact as soon as possible by getting the third party to make a note or send an email to you detailing exactly what happened. Who called? When? What did the collector say or ask? What did the third party do after receiving the call?
Remember the collector notes that the debt collector will produce in any lawsuit hardly ever show the collector doing something illegal such as calling your neighbors or friends. That is ok. These notes can often be shown to be very unreliable. Get your statement from the third party and you will have increased your chances of being successful.
